L’Application Mobile MAILLY3-4MAI et les services qu’elle génère sont éditées par la Mairie de Mailly-Le-Camp, 28 Rue Général de Gaulle, 10230 Mailly-le-Camp et la société Supersolids 19 rue des Fontenelles 52000 TREIX.

La Mairie de Mailly-Le-Camp et la société Supersolids, en, tant qu’éditeur, sont titulaires de l’ensemble des droits sur les Applications et les services qui leur sont associés.

L’Application Mobile MAILLY3-4MAI est compatible avec les systèmes d’exploitation mobile « ANDROID » développé par la société GOOGLE et « iOS » (version 13 et versions ultérieures) développé par la société Apple.

1. DÉFINITIONS 
   Cet article permet de définir les termes essentiels des présentes CGU.

Application Mobile : Désigne l’application mobile et les services qui y sont associés. Elle est notamment constituée d’un programme informatique, de mises à jour de ce programme informatique et de tout ou partie des éléments suivants : base de données, contenu éditorial, graphisme, photo, vidéo. Il s’agit d’un programme informatique rendu accessible par La Mairie de Mailly-Le-Camp  et  la société Supersolids via les Terminaux Mobiles de l’Utilisateur. 

Documentation : Désigne l’ensemble des informations éditées par la Mairie de Mailly-Le-Camp en rapport avec les équipements connectés et ses activités (notices, les liens les mentions légales et les Sites internet du 3-4mai1944 de La Mairie de Mailly-Le-Camp).

Données personnelles : Désignent toute information identifiante directement ou indirectement l’Utilisateur.

Données techniques : Désignent toute information technique relative aux équipements connectés utilisés par l’Utilisateur et notamment des informations portant sur les équipements connectés (références, versions firmware), des données de diagnostic (« compteurs de cycles ») et des données paramétriques (« Paramètres process », « Paramètres produit », « Paramètres utilisateur », « Jeux de paramètres »).

Sites internet : Désignent l’ensemble des pages web du 3-4mai.fr de La Mairie de Mailly-Le-Camp et des ressources liées et accessibles par une adresse URL.

Terminaux mobiles : Désignent les terminaux mobiles (ex : smartphones, tablettes..) de l’Utilisateur équipés du système d’exploitation « ANDROID » ou « iOS.

Utilisateur : Désigne toute personne physique majeure qui est responsable de l’utilisation de l’Application Mobile.

2. OBJET
Les présentes conditions générales d’utilisation (ci-après « CGU »), ont pour objet de définir les modalités d’accès et d’utilisation de l’Application Mobile éditée par La Mairie de Mailly-Le-Camp et  la société Supersolids, ainsi que des services qui lui sont associés.

3 . CHAMP D’APPLICATION DES CGU 
Les présentes CGU régissent les rapports entre La Mairie de Mailly-Le-Camp et les Utilisateurs de l’Application Mobile, et s’appliquent sans restriction ni réserve pour toute utilisation ou téléchargement de l’Application Mobile.

En téléchargeant et/ou en utilisant l’Application Mobile, l’Utilisateur confirme qu’il en a lu, compris et accepté les termes et conditions. Dans le cas où un Utilisateur n’accepterait pas les présentes CGU ou refuserait de s’y conformer, il ne doit pas utiliser l’Application Mobile. Dans ce cas, il est recommandé de désinstaller l’Application Mobile de son Terminal Mobile.

L’Utilisateur reconnaît que les présentes CGU s’appliquent uniquement entre lui et La Mairie de Mailly-Le-Camp et  la société Supersolids, et non avec le fournisseur de la place de marché en ligne sur laquelle l’Application Mobile lui a été proposée au téléchargement.

L’Utilisateur reconnaît en outre qu’en sa qualité d’éditeur, La Mairie de Mailly-Le-Camp est seule responsable l’Application Mobile concédée en licence, de leurs contenus et de toutes réclamations, garanties et assistance relative à leur utilisation.

Les présentes CGU sont accessibles à tout moment dans l’Application Mobile dans la rubrique « Mentions légales » du menu principal de l’Application Mobile et prévaudront, le cas échéant, sur toute autre version ou tout autre document contradictoire.

La Mairie de Mailly-Le-Camp pourra modifier les présentes CGU à tout moment, sans préavis et sans avoir à le communiquer préalablement aux Utilisateurs, dès lors que cela lui semble opportun. Les Utilisateurs seront informés de la modification des présentes par le biais de la publication des CGU actualisées. Les CGU modifiées prendront effet à partir de leur publication. La poursuite de l’utilisation de l’Application Mobile suite à cette publication constituera une acceptation de la nouvelle version des présentes CGU.

Il est donc conseillé aux Utilisateurs de lire très attentivement les présentes CGU et de consulter régulièrement les CGU mises à jour, soit dans la rubrique « Mentions légales » susvisée, soit sur l’onglet « Mentions légales » du Site internet 3-4mai.fr accessible à l’adresse URL suivante : https://3-4mai.fr/wp-content/uploads/Legal/CGU_mailly.pdf

4. DESCRIPTION DES SERVICES 
   Après avoir établie la connexion entre les Terminaux Mobiles et les équipements Connectés grâce à la technologie CPP, l’Application Mobile permet à l’Utilisateur :
   – d’accéder à l’appareil photo dans le but utiliser la réalité augmentée,
   – de paramétrer et de configurer les équipements Connectés,
   – d’accéder au site du 3-4mai 1944 de La Mairie de Mailly-Le-Camp.
5. ACCES AUX SERVICES
   L’Application Mobile est téléchargeable gratuitement via la plateforme de téléchargement « GOOGLE PLAY » mise à disposition par la société GOOGLE et la plateforme « App Store » mise à disposition par la société Apple.

Préalablement au téléchargement de l’Application Mobile, l’Utilisateur doit s’assurer qu’il dispose sur son Terminal Mobile du système d’exploitation « ANDROID » ou « iOS ».
Après téléchargement, l’Application Mobile sont accessibles en tout lieu à tout Utilisateur ayant un accès à Internet. Tous les frais supportés par l’Utilisateur pour accéder au service (matériel informatique, connexion Internet, etc.) sont à sa charge.

L’accès et/ou l’utilisation de l’Application Mobile sont réservés à un usage strictement personnel lors de l’utilisation de l’équipement connecté et requièrent la transmission des Aucune donnée personnelle de l’Utilisateur n’est enregistrée ou sauvegardée

La Mairie de Mailly-Le-Camp met en œuvre tous les moyens mis à sa disposition pour assurer un accès de qualité aux services accessibles via son l’Application Mobile dans la limite de ce qui est prévu aux articles 6 et 8 des présentes CGU.

6. GESTION ET MODIFICATION
Pour la gestion et les performances de son Application Mobile, La Mairie de Mailly-Le-Camp pourra à tout moment :
– suspendre, interrompre ou limiter l’accès à tout ou partie de son Application Mobile sans préavis pour réaliser une maintenance corrective et/ou évolutive et procéder à des mises à jour. L’utilisateur s’oblige à ne réclamer aucune indemnisation suite à l’interruption, à la suspension ou à la modification de l’application mobile.

– supprimer toute information pouvant en perturber le fonctionnement ou entrant en contravention avec les lois nationales ou internationales.
La Mairie de Mailly-Le-Camp se réserve le droit de lancer de nouveaux services mais aussi, le cas échéant, sans préavis et à son entière discrétion, de supprimer, d’améliorer ou de modifier tout ou partie des fonctionnalités, caractéristiques, rubriques et services de son Application Mobile.

7. PROPRIÉTÉ INTELLECTUELLE
L’Application Mobile est protégée par la loi française sur le droit d’auteur. Le titre de l’Application Mobile et tous les droits de propriété intellectuelle sur l’Application Mobile (textes, slogans, dessins, images, séquences animées sonores ou non, ainsi que toutes œuvres intégrées, modèles 3D) resteront à tout moment la propriété de La Mairie de Mailly-Le-Camp et de Supersolids.

La reproduction et l’utilisation, sur un support papier ou informatique, de l’Application Mobile sont autorisées sous réserve qu’elle soit strictement réservée à un usage personnel, excluant tout usage à des fins publicitaires et/ou commerciales et/ou d’informations, et qu’elle soit conforme aux dispositions de l’article L122-5 du Code de la Propriété Intellectuelle.

A l’exception des dispositions ci-dessus, toute reproduction, représentation, utilisation ou modification, par quelque procédé que ce soit et sur quelque support que ce soit, de tout ou partie de l’Application Mobile, de tout ou partie des contenus qui la composent, sans avoir obtenu l’autorisation préalable de La Mairie de Mailly-Le-Camp, est strictement interdite et constitue un délit de contrefaçon. Aucune licence, ni aucun droit autre que celui d’utiliser l’Application Mobile conformément à l’usage pour lequel elles sont prévues, n’est conféré à l’Utilisateur de l’Application Mobile au regard des droits de propriété intellectuelle et droit d’auteur.

8. RESPONSABILITÉ
8.1. Responsabilité de l’Utilisateur
L’utilisation de l’Application Mobile nécessite l’usage de Terminaux Mobiles et certains équipements Connectés dont l’Utilisateur sera pleinement responsable.
Il appartient à chaque Utilisateur de s’assurer du bon fonctionnement et de la configuration de ses Terminaux Mobiles. Ainsi, l’Utilisateur veillera notamment à la compatibilité, la bonne installation, l’exploitation, et la maintenance de ses Terminaux Mobiles, à leur interopérabilité avec les Équipements Connectés et l’Application Mobile.
L’Utilisateur sera également responsable de tous dysfonctionnements, attaques virales ou tentatives d’intrusion liés à ses Terminaux Mobiles et à son système d’exploitation. L’Utilisateur sera aussi responsable des Données Techniques qu’il importe et exporte au travers de l’Application Mobile.

L’Utilisateur sera responsable de toutes poursuites judiciaires à son encontre du fait des dommages causés à lui-même, à des tiers et/ou à ses Équipements Connectés du fait de l’utilisation de l’Application Mobile ou du fait du non-respect des présentes CGU.

8.2. Responsabilité de La Mairie de Mailly-Le-Camp
La Mairie de Mailly-Le-Camp est responsable de la bonne exécution de ses obligations contractuelles dans le cadre des présentes CGU et des législations et normes en vigueur.
La Mairie de Mailly-Le-Camp met en œuvre tous les moyens mis à sa disposition pour assurer un accès à son Application Mobile et à ses fonctionnalités.

8.3 Exclusions et limitations de responsabilité 
La Mairie de Mailly-Le-Camp et la société Supersolids ne pourront en aucun cas être tenue responsable vis-à-vis de l’Utilisateur ou d’un tiers de tout dommage indirect, incident, spécial ou accessoire – ce qui inclut, sans que cela soit exhaustif, toute perte de bénéfice ou autre perte indirecte -, résultant de l’utilisation de l’Application Mobile. La présente limitation de responsabilité s’applique dans toute la mesure autorisée par la loi.
La responsabilité de La Mairie de Mailly-Le-Camp ne saurait être engagée en cas d’inexécution ou de mauvaise exécution des présentes conditions imputables à l’Utilisateur ou à un tiers non autorisé, au fait imprévisible et insurmontable d’un tiers, ou à un cas de force majeure. Notamment, la responsabilité de La Mairie de Mailly-Le-Camp ne sera pas engagée :
– en cas d’incompatibilité ou dysfonctionnement des Terminaux Mobiles de l’Utilisateur, notamment en raison de leur ancienneté ;
– en cas d’obsolescence des Équipements Connectés ;
– en cas de défaillance, panne, difficulté ou interruption de fonctionnement empêchant l’accès à l’Application Mobile ou à une de ses fonctionnalités ;
– en cas de force majeure ou du fait imprévisible et insurmontable d’un tiers.
La Mairie de Mailly-Le-Camp exclut expressément toute forme de garantie, et notamment, toute garantie implicite relative aux conditions usuelles d’usage de son Application Mobile ou de l’aptitude de son Application Mobile à un usage normal ou à une utilisation spécifique, à sa qualité ou au respect de toutes dispositions légales. La présente limitation de responsabilité s’applique dans toute la mesure autorisée par la loi.

9. PROTECTION ET CONFIDENTIALITE DES DONNEES 
9.1 Concernant les Données Techniques
La Mairie de Mailly-Le-Camp veille à la sécurité et à la confidentialité des données. Aucune donnée personnelle n’est enregistrée ni stockée.

La Mairie de Mailly-Le-Camp héberge les Données Techniques traitées sur des serveurs sécurisés situés dans l’Union Européenne.

9.2 Concernant les Données Personnelles 

La Mairie de Mailly-Le-Camp ne traite aucune donnée personnelle. Ainsi nous n’enregistrons aucune information de type data sur aucun serveur. L’application est libre d’accès sans mot de passe. L’usage de l’appareil photo est réduit à l’utilisation unique de la réalité augmentée de l’appareil mobile. La Mairie de Mailly-Le-Camp n’utilise pas l’accès à la bibliothèque.

La Mairie de Mailly-Le-Camp à travers son application mobile utilise vos données de localisation afin de vous servir dans la page carte, mais n’enregistre à aucun moment vos données de localisation sur un serveur.

La Mairie de Mailly-Le-Camp veille à la sécurité et à la confidentialité de ces Données Personnelles relatives à l’utilisation de l’Application Mobile en conformité avec la législation en vigueur en la matière.

La Mairie de Mailly-Le-Camp n’héberge aucune Donnée.

10. DURÉE ET RÉSILIATION 
    L’Utilisateur de l’Application Mobile peut résilier de plein droit et à tout moment les présentes CGU en désinstallant l’application de son Terminal Mobile. L’Utilisateur sera réputé ne pas avoir accepté les versions précédentes des CGU, dès lors qu’il n’accepte pas les présentes CGU.
11. DROIT APPLICABLE 
    Les présentes conditions générales d’utilisation sont régies et interprétées conformément au droit français.

En cas de contestation liée à l’utilisation de l’Application Mobile, l’Utilisateur a la possibilité de recourir à une procédure de médiation conventionnelle ou à toute autre procédure de mode alternatif de règlement des différends.

1. DEFINITIONS
This article defines the essential terms of these UGC.
Mobile Application: Refers to the mobile application and the associated services. It consists notably of a computer program, updates to this computer program, and all or part of the following elements: database, editorial content, graphics, photos, videos. It is a computer program made accessible by the Town Hall of Mailly-Le-Camp and the company Supersolids via the User’s Mobile Terminals.
Documentation: Refers to all information published by the Town Hall of Mailly-Le-Camp relating to connected equipment and its activities (instructions, links, legal notices, and the websites of 3-4may1944 of the Town Hall of Mailly-Le-Camp).
Personal Data: Refers to any identifying information directly or indirectly related to the User.
Technical Data: Refers to any technical information relating to the connected equipment used by the User, including information about the connected equipment (references, firmware versions), diagnostic data (« cycle counters »), and parametric data (« Process Parameters », « Product Parameters », « User Parameters », « Parameter Sets »).
Websites: Refers to all web pages of 3-4mai.fr of the Town Hall of Mailly-Le-Camp and related resources accessible via a URL.
Mobile Terminals: Refers to the mobile terminals (e.g., smartphones, tablets) of the User equipped with the « ANDROID » or « iOS » operating system.
User: Refers to any adult natural person who is responsible for using the Mobile Application.

2. PURPOSE
These general terms and conditions of use (hereinafter « UGC ») aim to define the terms of access to and use of the Mobile Application published by the Town Hall of Mailly-Le-Camp and the company Supersolids, as well as the associated services.

3. SCOPE OF THE UCGS
These UCGS govern the relationship between the Town Hall of Mailly-Le-Camp and the Users of the Mobile Application and apply without restriction or reservation to any use or download of the Mobile Application. By downloading and/or using the Mobile Application, the User confirms that they have read, understood, and accepted the terms and conditions. In the event that a User does not accept these UCGS or refuses to comply with them, they must not use the Mobile Application. In this case, it is recommended to uninstall the Mobile Application from their Mobile Terminal. The User acknowledges that these T&Cs apply only between them and the Town Hall of Mailly-Le-Camp and the company Supersolids, and not with the provider of the online marketplace on which the Mobile Application was offered for download. The User also acknowledges that, as the publisher, the Town Hall of Mailly-Le-Camp is solely responsible for the Mobile Application licensed to them, their contents, and any claims, warranties, and assistance related to their use. These T&Cs are accessible at any time in the Mobile Application under the « Legal Notice » section of the main menu of the Mobile Application and will prevail, if applicable, over any other version or conflicting document. The Town Hall of Mailly-Le-Camp may modify these T&Cs at any time, without notice and without having to communicate them beforehand to Users, as it deems appropriate. Users will be informed of the modification of these T&Cs by the publication of the updated T&Cs. The modified T&Cs will take effect upon publication. The continued use of the Mobile Application following this publication will constitute acceptance of the new version of these T&Cs. 4. DESCRIPTION OF SERVICES
After establishing the connection between Mobile Terminals and Connected Equipment using CPP technology, the Mobile Application allows the User to:
– access the camera for the purpose of using augmented reality,
– configure and set up Connected Equipment,
– access the site of 3-4may 1944 of the Town Hall of Mailly-Le-Camp.

5. ACCESS TO SERVICES
The Mobile Application can be downloaded for free via the « GOOGLE PLAY » download platform provided by GOOGLE and the « App Store » platform provided by Apple. Prior to downloading the Mobile Application, the User must ensure that their Mobile Terminal has the « ANDROID » or « iOS » operating system. After downloading, the Mobile Application is accessible anywhere to any User with internet access. All costs incurred by the User to access the service (computer equipment, internet connection, etc.) are at their expense. Access and/or use of the Mobile Application are reserved for strictly personal use when using the connected equipment and require the transmission of No personal data of the User is recorded or saved. The Town Hall of Mailly-Le-Camp makes every effort to ensure quality access to services accessible via its Mobile Application within the limits of what is provided for in Articles 6 and 8 of these T&Cs.

6. MANAGEMENT AND MODIFICATION
For the management and performance of its Mobile Application, the Town Hall of Mailly-Le-Camp may at any time:
– suspend, interrupt, or limit access to all or part of its Mobile Application without notice to perform corrective and/or evolutionary maintenance and updates. The User agrees not to claim any compensation following the interruption, suspension, or modification of the mobile application.
– delete any information that may disrupt its operation or contravene national or international laws.
The Town Hall of Mailly-Le-Camp reserves the right to launch new services, but also, if necessary, without notice and at its sole discretion, to delete, improve, or modify all or part of the features, characteristics, sections, and services of its Mobile Application.

7. INTELLECTUAL PROPERTY
The Mobile Application is protected by French copyright law. The title of the Mobile Application and all intellectual property rights in the Mobile Application (texts, slogans, designs, images, animated or non-animated sequences, as well as all integrated works, 3D models) will remain at all times the property of the Town Hall of Mailly-Le-Camp and Supersolids. Reproduction and use, on paper or computer, of the Mobile Application are authorized provided that it is strictly reserved for personal use, excluding any use for advertising, commercial,

and/or informational purposes, and that it complies with the provisions of Article L122-5 of the Intellectual Property Code. Except as provided above, any reproduction, representation, use, or modification, by any means whatsoever and on any medium whatsoever, of all or part of the Mobile Application, of all or part of the content composing it, without having obtained the prior authorization of the Town Hall of Mailly-Le-Camp, is strictly prohibited and constitutes an infringement. No license or right other than that to use the Mobile Application in accordance with the purpose for which it is intended is granted to the User of the Mobile Application with respect to intellectual property rights and copyright.

8. LIABILITY
8.1. User’s Liability
The use of the Mobile Application requires the use of Mobile Terminals and certain Connected Equipment for which the User will be fully responsible. It is the responsibility of each User to ensure the proper functioning and configuration of their Mobile Terminals. Thus, the User will ensure, in particular, the compatibility, proper installation, operation, and maintenance of their Mobile Terminals, their interoperability with the Connected Equipment and the Mobile Application. The User will also be responsible for any malfunctions, viral attacks, or intrusion attempts related to their Mobile Terminals and operating system. The User will also be responsible for the Technical Data that they import and export through the Mobile Application. The User will be responsible for any legal action against them for damages caused to themselves, third parties, and/or their Connected Equipment due to the use of the Mobile Application or the non-compliance with these T&Cs.

8.2. Liability of the Town Hall of Mailly-Le-Camp
The Town Hall of Mailly-Le-Camp is responsible for the proper performance of its contractual obligations under these T&Cs and the applicable laws and regulations. The Town Hall of Mailly-Le-Camp makes every effort to ensure access to its Mobile Application and its features.

8.3 Exclusions and limitations of liability
The Town Hall of Mailly-Le-Camp and Supersolids shall not be liable to the User or any third party for any indirect, incidental, special, or consequential damages – including, without limitation, any loss of profit or other indirect loss – resulting from the use of the Mobile Application. This limitation of liability applies to the fullest extent permitted by law. The liability of the Town Hall of Mailly-Le-Camp shall not be incurred in the event of non-performance or improper performance of these conditions attributable to the User or an unauthorized third party, to the unforeseeable and insurmountable act of a third party, or to force majeure. In particular, the liability of the Town Hall of Mailly-Le-Camp shall not be incurred:
– in case of incompatibility or malfunction of the User’s Mobile Terminals, notably due to their age;
– in case of obsolescence of the Connected Equipment;
– in case of failure, breakdown, difficulty, or interruption of operation preventing access to the Mobile Application or one of its features;
– in case of force majeure or the unforeseeable and insurmountable act of a third party.
The Town Hall of Mailly-Le-Camp expressly excludes any form of warranty, including any implied warranty regarding the usual conditions of use of its Mobile Application or the suitability of its Mobile Application for normal use or specific use, its quality, or compliance with all legal provisions. This limitation of liability applies to the fullest extent permitted by law.

9. DATA PROTECTION AND CONFIDENTIALITY
9.1 Concerning Technical Data
The Town Hall of Mailly-Le-Camp ensures the security and confidentiality of data. No personal data is recorded or stored. The Town Hall of Mailly-Le-Camp hosts the Technical Data processed on secure servers located in the European Union.

9.2 Concerning Personal Data
The Town Hall of Mailly-Le-Camp does not process any personal data. Thus, we do not record any data type information on any server. The application is freely accessible without a password. The use of the camera is limited to the unique use of augmented reality on the mobile device. The Town Hall of Mailly-Le-Camp does not use access to the library. Through its mobile application, the Town Hall of Mailly-Le-Camp uses your location data to serve you on the map page but does not record your location data on a server at any time. 10. DURATION AND TERMINATION
